These terms are the agreement between you and SetBlue ("we", "us") for using the FestivePost app and its server (together, "the service"). By installing or using the app you agree to them. If you don't agree, please don't use the service. How we handle your information is explained in our Privacy Policy, which is part of these terms.
1. What the service is
FestivePost helps you make and share greeting cards: you choose a design, add text, names, photos and a logo, and save or share the finished image. It can write a wish for you with AI, search royalty-free photos, remind you of festivals, birthdays and anniversaries, and make cards for many people at once. Your cards, photos, logos and the dates and names you save are kept on your phone.
The app is free at the moment. If we add paid features we will say so clearly before you are charged, and these terms will be updated.
2. Who can use it
You must be at least 13 years old. If you are under 18, please use the app with a parent or guardian's permission. You need to be able to form a binding agreement where you live.
3. Your content
"Your content" is what you put on a card or into the app: text, names, photos, logos and the details you register with.
- It stays yours. We don't claim ownership of your content, and your cards stay on your phone.
- What we need to do with it. You allow us to process the parts you send to our server (your registration details, and the details of an AI wish request) only to run the service, as the Privacy Policy describes.
- You must have the right to use it. Only add photos, logos, names and words that you own or have permission to use, and that don't break anyone's rights.
- You are responsible for it, including every card you create and everyone you send it to.
4. Using the service properly
Please don't:
- make or send anything unlawful, hateful, threatening, harassing, defamatory, sexually explicit or deceptive, or that infringes someone's rights;
- pretend to be someone else or send greetings in a way meant to mislead;
- use cards for spam. When you make cards for many people, send them only to people who would welcome them, and follow the rules of the app you send them through (for example WhatsApp);
- copy, resell or redistribute our template designs or artwork as a template collection, or scrape the service;
- try to break, overload or get around the service or its limits, reverse engineer it, or access it in an automated way;
- use it in a way that breaks the law.
We may limit or stop access if the service is being misused.
5. AI-written wishes
- Wishes are produced by an AI service, or by a built-in writer on your phone when the AI is unavailable. They can contain mistakes, awkward wording, or text that doesn't fit your situation.
- Wishes in Hindi and Gujarati, and references to festivals, traditions and beliefs, may not be right for every region or community.
- Please read and edit every wish before you send it. You are responsible for what you send.
- To keep the service fair and affordable we limit how many AI wishes each person can have in a day. Beyond that, wishes are written on your device instead.
6. Festival dates and reminders
- Many festivals fall on different days in different regions and communities, and some dates come from outside calendars and can be a day off. We try to keep dates accurate but do not guarantee them. Check important dates yourself.
- Reminders are notifications scheduled on your phone. They depend on your phone's settings, permissions and battery or system limits, so a reminder may be late or missed. Don't rely on them for anything important.
- You enter birthdays and anniversaries yourself. We don't check them.
7. Photos and other services
- Background photos come from Unsplash and are credited to their photographers. They are used under Unsplash's own licence and terms, which apply to those photos.
- The service relies on other providers, such as Google (AI), our database and hosting providers, and the apps you share to (such as WhatsApp). Their terms and policies apply to their services, and we are not responsible for them.
- The app's designs, artwork, wording and software belong to us or our licensors. You may use the cards you make for your personal greetings and for your business's own greetings and promotions.
8. Availability and changes
We work to keep the service running, but we don't promise it will always be available or error-free. Some features need an internet connection. We may change, add or remove features, and we may suspend or end the service, with notice where reasonable.
9. No warranty
The service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties, whether express or implied, including about quality, accuracy of dates, accuracy of AI-written text, or fitness for a particular purpose.
10. Limit on our liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of profits or data, or for anything that results from a missed reminder, a wrong date, an AI wish you sent without reading, or content you or others created. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the last 12 months, or INR 1,000 (or the nearest equivalent) if you paid nothing. Nothing in these terms limits liability that cannot lawfully be limited, or any consumer rights you have that cannot be waived.
11. Ending your use
You can stop using the app at any time. To remove your information, use Settings → Delete my data in the app, or follow the steps in the Privacy Policy. We may suspend or end your access if you break these terms or misuse the service.
12. Governing law
These terms are governed by the laws of India, and the courts there have jurisdiction, unless the consumer protection laws of the place where you live give you the right to use your own courts.
13. Changes to these terms
We may update these terms. We will change the "last updated" date above and, for significant changes, tell you in the app. If you keep using the service after a change, you accept the updated terms.
14. General
These terms and the Privacy Policy are the whole agreement between you and us about the service. If a part is found unenforceable, the rest still applies. If we don't enforce a term straight away, we haven't given it up.
